Modification Of Child Support, Child Custody & Other Divorce Orders

Because life variables can change, many arrangements concluded in a divorce decree or child custody agreement may need to be revisited. Texas law allows modifications to divorce decrees or suit affecting a parent-child relationship if both parties mutually decide to alter the terms, OR if there has been material and substantial changes in circumstances for a party or of a child.

Reasons to modify a Court order may include:

  • Significant life changes such as major changes in work schedules
  • A parent moves a great distance away or out-of-state
  • A parent receives a new job opportunity or experiences a job loss
  • One or both parents remarry
  • Denial or obstruction of parental visitation time
  • Unexpected health issues of a child
  • Original orders entered in your absence (common for military service personnel)
  • Misconduct and unfit parenting such as abuse, neglect or a parents’ involvement in drug or alcohol abuse
  • Domestic violence
  • The original custody and visitation arrangement is no longer in the child’s best interest anymore

What Justifies a Modification?

If parties do not mutually agree on the change of circumstances to the Court order, then the following will need to apply to move forward with a modification:

  • Material and substantial changes in circumstances: Texas law allows modifications if circumstances change significantly for one partner, the child or of the marriage. For example, the court may modify the term of spousal maintenance if the paying spouse loses employment. In addition, parties can request modification due to a move, work relocation or similar life-altering event such as remarriage. Whatever the situation, courts are more likely to modify continual financial obligations such as alimony rather than property divisions or debt distributions.
  • The court may also modify a child support order if the following applies: It has been three years since the order was rendered or last modified and the monthly amount of the child support award under the order differs by either 20 percent or $100 from the amount that would be awarded in accordance with the child support guidelines.
